TERMS AND CONDITIONS
These are the General Terms and Conditions of Betsmarter Group Pty Ltd (ACN 670 262 950) trading as topbet (hereinafter topbet).
topbet is licensed by Greyhound Welfare and Integrity Commission (GWIC) and regulated by Liquor & Gaming NSW to accept wagers via the internet and the telephone 24 hours a day.
GENERAL PROVISIONS
1) The provisions contained in these General Terms & Conditions are subject to change without notice. It is the responsibility of any person seeking to rely on these General Terms & Conditions to ensure that they are referring to the most recent version of our General Terms & Conditions by visiting the topbet Sites.
2) Where they appear in these General Terms & Conditions, the following terms and expressions have the meaning attributed to them in this Clause:
a) "topbet Rules" means any rules from time to time propagated by topbet in respect of the topbet Sites and their use, and include:
i) These General Terms & Conditions; and
ii) The topbet Betting Rules, which includes any rules that we promulgate for betting, sport and other events on which we accept bets.
b) "topbet Sites" or “our Sites” means our wagering Sites located at www.topbet.com.au .
c) "Customer" means a registered holder of a topbet Customer Account.
d) “Customer Account” or “Account” means the betting account that a Customer holds with us.
e) "Customer Credentials" means your topbet User ID and access password.
f) “Odds” includes odds, prices or lines.
3) Any references to "you" or "your" in these General Terms & Conditions is a reference to a topbet Customer.
4) Any references to "we", "us" or "our" in these General Terms & Conditions is a reference to topbet.
5) You agree that topbet offers a wagering service whereby Customers have the ability to place a bet with the possibilities of a win or a loss.
6) By opening a topbet Customer Account, or by placing a bet with topbet, you are deemed to have read, and agreed to be bound by:
a) The terms and conditions set out hereunder;
b) The topbet Betting Rules; and
c) The topbet Privacy Policy.
7) You agree to be contractually bound to the topbet Rules each time you access your Customer Account and each time you place a bet with us. You agree that each of these actions creates a contract between you and us.
8) These topbet Rules shall be governed by, and construed in accordance with, the Laws of the State of New South Wales and, in the event of any dispute arising from or in connection with them, topbet and the Customer irrevocably submit to the exclusive jurisdiction of the courts of New South Wales.
9) You agree that it is your responsibility to pay any tax or duty imposed on you by any competent authority in connection with your wagering activity.
10) You agree that if you keep the direct marketing consent box checked on sign-up, you are opting into Direct Promotional Marketing in the form of email, SMS and telephone. All email and SMS marketing can be opted out of at any time, and additionally this setting can be updated at any time in the 'My Account' section of the topbet Sites.
RESTRICTIONS ON USING OUR SITES
1) In accessing or using our Sites you agree that you will not:
i) use any automated device, software, process or means to access, retrieve, scrape, or index our Sites or any content on our Sites without our express prior written consent;
ii) use any device, software, process or means to interfere or attempt to interfere with the proper working of our Sites;
iii) undertake any action that will impose a burden or make excessive traffic demands on our infrastructure that we deem, in our sole discretion to be unreasonable or disproportionate site usage;
iv) use or index any content or data on our Sites for purposes of competing with us in any manner that we have not specifically authorised;
v) transmit spam, chain letters, contests, junk email, surveys, or other mass messaging, whether commercial in nature or not;
vi) use our Sites or any content from our Sites in any manner which is, in our sole discretion, not reasonable and / or not for the purpose it is made available;
vii) violate the rights of any person, including copyright, trade secret, privacy right, or any other intellectual property or proprietary right;
viii) pose as any person or entity or attempt to solicit money, passwords or personal information from any person;
ix) act in violation of the topbet Rules or any applicable law;
x) reproduce, republish, retransmit, modify, adapt, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit our Sites or any content on our Sites, except as expressly authorised by us; or
xi) transmit or attempt to transmit any computer viruses, worms, defects, Trojan horses or other items of a destructive nature;
xii) use, communicate, resupply, copy or otherwise exploit digital content on the Sites without prior authorisation, including by exploiting the content in any public place including commercial venues (pubs, clubs, stadiums, racecourses and casinos) or for any purpose other than private viewing by you.
2) We reserve the right to prevent unauthorised access to or use of our Sites, including, but not limited to, instituting technological barriers, or reporting your conduct to any person or entity.
CUSTOMER RESPONSIBILITY
By creating an Account with us and every time you access or use our Sites or Apps you warrant to us and agree to the following:
1) You are 18 years of age or older.
2) You are legally capable of entering into binding contracts and have legal capacity to do so.
3) You are legally able to access our Sites from your location.
4) Your Account is for your own personal use. You must not permit another person to access your Account unless topbet has been provided prior notice of that activity and has approved the activity. In determining whether to approve such activity, topbet may request identification documents for the secondary user and will have absolute discretion.
5) You must not use your Account on behalf of or for the benefit of another person. Where topbet has reasonable suspicion that this is occurring it may take whatever action it deems appropriate, including but not limited to suspension of your account, voiding of pending and resulted bets, restriction of the products available on your account or account closure.
6) You are responsible for ensuring that your records, in particular address, telephone number and payment/bank details (including any debit card expiration details), are kept up-to-date and to notify us immediately of any incorrect Account details. In the event that you have not kept your records up to date, topbet reserves the right to suspend the Account.
7) You are the true and lawful owner of the monies that you deposit into your Account, withdraw from your Account and wager with us, and you are duly and properly authorised to utilise such monies for the aforementioned purposes.
8) You will not deposit or wager any monies with us that are derived from illegal activities.
9) You will not attempt to complete transactions or place wagers on your Account after self-excluding your Account through our Sites, apps or external self-exclusion register (e.g. BetStop).
10) Your contact details, including name, date of birth, email address, mobile number and mailing address are valid, accurate and complete, and may be used by topbet to keep you informed about products, promotions, services and events. topbet does not sell personal information to other companies.
11) If you want to change your contact mechanism (specifying direct mail, telephone or email), or opt out of any communications from topbet, you can do so by emailing [email protected].
12) It is your responsibility to ensure that you keep your user ID and password confidential. If you suspect that your details may no longer be confidential, you should notify topbet immediately and reset your password immediately.
13) If you wish for another individual to have access to your Account this must first be approved by topbet and details for that person provided. If approved, you remain solely responsible for your Account, including but not limited to transactions and bets made by any authorised individual.
14) You will be responsible for all wagers in which your user ID and password are used for any activity on your topbet Account. Any wager made by telephone or via the Internet where the user ID has been used will be regarded by topbet as being valid and may not be changed, cancelled or modified except at the sole discretion of topbet management.
15) Subject to the opt-out provisions in topbet’s Privacy Policy, you consent and agree that upon opening an Account, information regarding your Account can be sent to you by post and/or electronic means, including but not limited to SMS messaging and email. For the avoidance of doubt, you accept that there is a risk that information may come into the possession of another person not entitled to receive such information. Accordingly, you acknowledge that whilst topbet will take all reasonable steps to protect your privacy, it accepts no liability for breach of confidentiality or damages for any loss that you may suffer, provided topbet can show it communicated to you at a physical address, postal address, electronic address or phone number supplied by you or later discovered by topbet using any information supplied by you.
16) topbet makes every reasonable effort to prevent self-excluded customers from returning and using our service. If you wish to self-exclude, temporarily or permanently, you may do so at any time, by logging into your Account and visiting “My Account- Responsible Gambling- Self Exclusion Options”. You may also exclude yourself from betting with any licenced telephone or online Australian wagering operator through BetStop, which is the National Self-Exclusion Register, located at www.betstop.gov.au. If you are self-excluded, you must not attempt to open an Account or place any bets with us. However if you deliberately seek to circumvent our reasonable systems to open a duplicate Account whilst you are self-excluded you are fully liable for your actions and for all activity and bets placed on your Account.
CUSTOMER VERIFICATION REQUIREMENTS
1) Customers are required to provide topbet with adequate identification information for the purposes of complying with the verification requirements of the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) ('AML Act').
2) topbet is required by the AML Act to verify your identification information immediately upon your application to open an Account. If your identification information is not verified in accordance with the Act, your Account will be automatically suspended. Customers will be unable to deposit money into their Account or place bets until their identification has been verified.
3) Customer identification information ('ID') means your name, residential address ('address') and date of birth, as provided to topbet upon applying for your Account. Customers who do not provide full details up-front will have their Account suspended without notice.
4) After you open an Account with topbet, you accept that topbet will supply your ID to a third party (e.g. GreenID) for the purpose of ID verification. This usually involves checking your ID against third party databases and/or credit headers.
5) Where we are unable to verify your identity automatically with an online identity verification company such as Green ID, we may also request that you provide a photo of yourself holding photo identification, such as a driver’s license or passport. This information can be sent via email to [email protected]
6) Where topbet has a reasonable suspicion that the Account holder is not the true or beneficial holder of the Account, it may request any further information it deems necessary to establish/confirm the true identity of the Account holder. This may include the provision of statutory declarations and certified copies of identification or financial documents. Any such Account will be suspended pending receipt of appropriate documentation evidencing the beneficial owner of the Account. The decision to suspend or re-open the Account will be at the absolute discretion of topbet.
7) Where we know or suspect on reasonable grounds that you are not who you claim to be, or that you or any of your transactions may be linked to a crime, we are subject to the reporting obligations under the AML Act.
8) If a Customer uses a debit card to fund their Account, topbet may at any time require the Customer to verify that card. This will involve the Customer providing a photo of themselves holding the debit card, front on. Withdrawals may be withheld from any card which has not been verified.
9) topbet reserves the right at its discretion to refuse to accept a debit card including but not limited to circumstances where the card is dishonoured.
10) Debit cards used to fund a Customer’s account must match the Customer’s account details. Debit cards with a name other than that which is registered with topbet for the account in question may be refused and the account may be suspended until proof of consent is provided by the third-party cardholder.
TOPBET’S RESERVED RIGHTS
1) topbet reserves the right to cancel, change or restrict the products or bet types available to Customers at any time with or without notice to Customers, subject to the various minimum bet laws in place across various jurisdictions.
2) topbet only accepts members who are 18 years of age or above. We seek personal documents to verify identity information given to us. We expect parents and guardians not to allow minors to use our services under any circumstances. If you suspect someone underage is using the topbet Sites, please contact us and appropriate action will be taken. Internet filters can reduce the chance of underage gambling and we recommend Cyberpatrol, Gamblock, Forcepoint, 27Labs, BetFilter.
3) topbet has made considerable efforts to ensure its betting business operates in a fair, prompt and accurate manner. Save to the extent permitted by law (and only to such an extent), topbet excludes all warranties (express or implied) relating to its sports betting business and shall not have any liability for direct, indirect or consequential loss, damage, expense or injury suffered by any Customer.
4) Nothing in these Rules affects our liability:
i) to pay any Customer winnings or other amounts properly owing to such Customer pursuant to these Rules;
ii) for death or personal injury arising from our negligence;
iii) for our fraudulent misrepresentation; or
iv) for any matter in respect of which our liability cannot be excluded or limited under applicable law.
5) Subject to 3) and 4) above, topbet's liability in respect of any claim or loss shall be limited in amount to the relevant wager placed by a Customer.
6) topbet reserves the right to void any or all wagers made by any individual or group of people acting together either in an attempt to defraud topbet or to gain financial benefit through the manipulation of Tote-based dividends or official starting prices. This can include persons, relatives, organisations, bookmakers and their employees.
7) Where topbet reasonably considers that an Account is being used dishonestly or has been used by, or for the benefit of a third party who is not the Account holder, we may void any pending or resulted bets and close the Account.
8) topbet products and bet types are intended for bona fide Customers, that is, those Customers who act in good faith, sincerely, without fraud, and who place a bet with topbet for the purpose of recreation and entertainment.
9) Subject to the various minimum bet laws in place across various jurisdictions, topbet reserves the right, in its sole discretion, to determine that a Customer is not eligible for certain products, bet types or promotions.
10) topbet reserves the right to close or suspend the Accounts of, and/or void or allow to stand any or all bets made by any person where, in topbet's reasonable opinion, the Account has not been operated with integrity and/or the bet has not been placed on a good faith basis including (without limitation) where a person:
i) knowingly exploits, or intentionally seeks, to exploit a market or the topbet Rules (including by deception);
ii) seeks to manipulate the outcome of a market (whether or not for personal gain);
iii) receives an unjust advantage from information which is not known to the public; or
iv) intentionally abuses an inadvertent error in the description of a market (whether before or after topbet corrects the relevant descriptor).
11) topbet may suspend or terminate your Account at any time for legal reasons, where we have reason to believe that you are in breach or may be in breach of these Terms. Without limiting the preceding sentence, we may close or suspend your Account if:
i) you have permitted another person to use your Account;
ii) you have permitted a minor to use your Account;
iii) you are an employee or agent of a wagering operator;
iv) you become bankrupt;
v) topbet holds concerns that operation of your account may be in contravention of the AML Act;
vi) you have used our Sites in a fraudulent manner or for illegal, unlawful or improper purposes;
vii) you have been abusive or threatening toward our staff;
viii) you have not provided us with identification we have requested;
ix) we are directed or requested to do so by a government agency, the police, a regulatory authority, a racing or sporting controlling body, or a court; or
x) we consider that any of the events referred to above may have occurred or are likely to occur.
12) When a Customer has been referred to topbet by a third-party, where that third party is an affiliate or agent of topbet, you acknowledge that topbet may make commission payments to that third party. Any such payment is unrelated to the odds offered to the Customers of topbet.
13) If a Customer receives a Bonus Bet or other promotional credit, topbet reserves the right to remove the bonus and refund the remaining balance should a Customer be in breach of the topbet Rules.
14) A Customer may only have one Account, unless otherwise agreed to by topbet. If a Customer has additional Accounts, then topbet reserves the right to transfer the Account balances of all associated Accounts into the original Account and:
i) if, after the transfers, the original topbet Account has a debit balance, then topbet shall be entitled to receive payment for the debit balance as a debt that is immediately due and payable; or
ii) if, after the transfers, there is a credit balance in the original topbet Account, the credit balance will be held by topbet until such time as a determination has been made by topbet as to whether or not there has been a breach of the topbet Rules.
DEPOSITS AND WITHDRAWALS
1) Customers may deposit into their Account via debit card, direct deposit, EFT or PayID. topbet will only accept deposits and/or bets from customers whose identity has been verified.
2) If an Account is funded from a bank account or debit card in a different name to the Account holder, we reserve the right to void or cancel any bets on the Account and return the deposited funds to the bank account or debit card from which they were deposited. Where an Account has not been funded on a good faith basis, we may refuse future transactions and retrospectively void existing ones, at our discretion. If we consider that a deposit or withdrawal may potentially be fraudulent, we reserve the right to request proof of deposit or withdrawal bank account information to verify that the information provided is true and correct prior to permitting funds to be withdrawn from the Account.
3) topbet requires that any deposit into a Customer's Account be turned over at least once prior to authorising a withdrawal from the Customer's Account.
4) topbet does not charge Customers fees in relation to debit card transactions, nevertheless the card holder may be charged a fee by their own banking institution upon depositing funds with topbet which is your responsibility to pay.
5) The Customer understands that when they deposit funds (e.g. via debit card, PayID, direct deposit or EFT) with topbet they are purchasing a top-up of their online wagering account with us.
6) Customers must have completed the identification verification process prior to any withdrawal being processed.
7) If a Customer uses their debit card to fund the Account, the equivalent of the amount received off each card may be refunded back to that same card from future withdrawals.
8) If topbet determines that the risk presented from a payment to or from an Account is unacceptable, topbet reserves the right to cancel the deposit or withdrawal.
9) Without limitation, we reserve the right to withhold or delay the payment of withdrawals from your Account where:
i) we reasonably believe that the withdrawal is being made by another person and not by you;
ii) we reasonably believe that one or more deposits were made by another person and not by you;
iii) moneys deposited in your Account have not been received in our bank account in clear funds;
iv) you have not bet through or turned over each amount deposited in your Account at least once (unless approved by us); or
v) you have not verified your debit cards.
10) Winnings will be credited to a Customer's Account following confirmation of the final result. Should funds be credited to a Customer's Account in error for any reason, it is the Customer's responsibility to notify topbet of the error without delay and the Customer shall return to topbet any funds credited in error. Any wrongful credited amounts are immediately due and payable by the Customer to topbet regardless as to whether any funds have been paid to the Customer following the error or the Customer has made wagers that negatively affect their Account Balance.
DISHONOURED PAYMENTS AND CHARGEBACKS
1) Customers agree and warrant that no charge-backs or other cancellation of deposits will be made relating to your Account without our consent. In the event of any of the foregoing occurring, you agree to indemnify us for any costs, claims, damages and expenses relating to or arising in connection with this, including any expense incurred by us in recovering such amounts.
2) If you use any topbet banking specific options (EFT or PayID) you accept that topbet may request a certified or non-certified bank statement to verify where funds have originated from prior to any withdrawal being approved. You also accept that topbet may decide to return these funds at its discretion and void bets should it deem the funds may be unauthorised.
3) In the event that any action for which you are responsible results in your account having a negative balance, you agree that this is a debt that is immediately due and repayable to us.
FRAUD
1) Where topbet has a reasonable suspicion of fraudulent activity related to an Account, including but not limited to debit card fraud, we reserve the right to:
i) suspend the Account pending the completion of an investigation; and/or
ii) request further information or documentation from the Customer;
iii) cancel any pending or resulted bets which have been placed using funds from a misused or fraudulent debit card; and/or
iv) withhold deposited funds and/or winnings from resulted bets; and
v) close the Account if there are reasonable grounds established for believing fraud has occurred.
2) Any matters of inappropriate or fraudulent use of any debit card may also be reported to the relevant law enforcement authority.
3) topbet may track and store technical information on the device that Customers choose to use. Customers accept that this data may be used to reach decisions on investigations where Accounts have not been operated in good faith, including but not limited to Account takeover, bonus or betting abuse, multiple Account operations, payment method abuse etc.
4) topbet may periodically review Accounts to monitor any activity that it might consider unusual. In this instance, topbet reserves the right to suspend an Account pending a full investigation, without notice.
PLACEMENT AND ACCEPTANCE OF BETS
1) All bets on an Account are considered to be placed and received in New South Wales, Australia.
2) Subject to these Terms and prescribed minimum bet limits, topbet reserves the right at any time to refuse any bet or part of a bet without providing a reason or advance notification. The circumstances in which we may refuse a Customer’s bet include but are not limited to:
i) a Customer is or may be less than 18 years of age;
ii) a Customer is or may be betting on behalf of a person who is less than 18 years of age;
iii) a Customer is or may be in breach of the topbet Rules;
iv) a Customer is or may be in breach of any applicable law; or
v) a Customer's proposed bet would present an unacceptable liability risk to our business. Whether there is an unacceptable liability risk to us for the purpose of this paragraph is at topbet's discretion.
3) In the case of wagers accepted by topbet in accordance with these Terms:
i) Wagers may only be accepted up to the advertised start time, actual start time, or such earlier time as dictated by topbet.
ii) If a wager is inadvertently accepted in respect of an event after its start time, the wager shall be deemed to have been made invalidly and will be refunded to the Customer.
4) In the case of internet wagers and subject to these Terms and Conditions and prescribed minimum limits:
i) topbet has absolute discretion over which Odds it may choose to offer a Customer;
ii) topbet reserves the right to refuse to accept a wager in its absolute discretion.
iii) All Odds (including fixed odds) displayed on the topbet Sites are indicative only until the Customer has logged in to their account and may change before the wager is accepted by topbet. The only Odds offered by topbet are those that are displayed after the Customer has logged in, and at the time the wager is confirmed by a Customer. All Odds offered to a Customer are subject to the wagering limits as described in the topbet Rules and are subject to variation until the time a wager is accepted by topbet. For tote derivative products the final price is not known until dividends are declared.
5) In the case of telephone wagers, topbet has absolute discretion over which Odds it may choose to offer a Customer. The Odds offered by topbet are those outlined to the Customer by the telephone operator at the time of the Customer making the wager. All Odds offered to a Customer are subject to the wagering limits as described in the topbet Rules and are subject to variation until the time a wager is accepted by topbet. For tote derivative products the final price is not known until dividends are declared.
6) When a Customer is making a bet on their Account via the Internet, it is only accepted once the Customer submits the bet and a confirmation is received by the Customer. This will be accompanied by a ticket number.
7) When a Customer is making a bet on their Account via the telephone, the Customer is responsible for quoting the correct Account details. A bet is accepted when a Customer either indicates agreement with a bet after it has been read back to the Customer or, if the Customer does not disagree with the bet details, when read back to the Customer before the telephone call ends.
8) In the event a telephone conversation between a topbet representative and a Customer in which a bet is being placed is interrupted for any reason (including a mobile phone dropping out) prior to the conclusion of the conversation, any unconfirmed bet will be deemed not to have been placed. In such circumstances, it is the responsibility of the Customer to contact us promptly to confirm the bet the Customer wishes to make.
9) Customers are unable to change or cancel a bet once the bet has been accepted by topbet except at the sole discretion of topbet management.
10) The minimum bet on the Internet is $5.
11) The minimum bet via the telephone is $25.
12) The maximum telephone or internet wager (or series of telephone or internet wagers) that topbet is compelled to accept at the Odds it offers, is that wager amount so prescribed by law that when applied to the applicable Odds offered and the circumstances of the wager, would result in the maximum amount topbet is compelled by law to pay out on any wager or series of wagers (see minimum bet limits at the end of this document).
ERRORS
1) topbet endeavours to ensure that no errors are made in setting markets including but not limited to errors in Odds offered, available selections offered, bets accepted on an Account or any errors in exclusions for certain selections. However, we reserve the right to correct errors and to void any bets prior to or after an event in circumstances where a bet has been accepted and where there has been a material technical, human or other error in setting a market and/or in accepting a bet.
2) Where a bet is voided by topbet prior to an event commencing, we will endeavour to contact you by email promptly to inform you that your bet has been voided.
3) An error in setting a market or accepting a bet will be material in any of the following circumstances:
i) the price struck for a bet is materially greater than a price historically offered on the same or a similar market by topbet or a competitor bookmaker;
ii) there is an error in the price of at least one selection which forms part of a multiple bet; the combined effect of which results in a materially erroneous price;
iii) the available selection(s) on a market are so different from the selection(s) historically offered on the same or a similar market by topbet or a competitor bookmaker; or
iv) a person with a good understanding of wagering would reasonably understand that there was an error in a relevant market or in the acceptance of the bet.
4) In any of the above circumstances identified under ‘Errors’:
i) A bet includes a single bet or a multiple bet; and
ii) If the erroneous price or selection is part of a multiple bet placed by you, the multiple bet will be either re-calculated at adjusted (correct) prices or by excluding the event to which the error relates, at topbet's absolute discretion.
MAXIMUM PAYOUTS
1) Subject to our other terms and conditions contained in the topbet Rules and in particular other win limits, the maximum payout we shall be obliged to pay to you is as follows:

2) You acknowledge and agree that for certain bet types your accepted stake or bet may mean that you have the opportunity to win more than a win limit or maximum payout set out in this clause or otherwise in the topbet Rules. Even where your approved stake or bet may give you the opportunity to win a higher amount, you agree that we shall only be obliged to pay to you the win limit or maximum payout specified in this clause or otherwise in the topbet Rules including but not limited to our Racing Rules or Sport Rules. If we impose a win limit or maximum payout on your winning bet and payout, we may refund to you the portion of your stake or bet that, at the designated Odds, may have resulted in a payout to you above a win limit or maximum payout.
3) The maximum dividend for any tote bet is 50% greater than (i.e. 1.5 times) the amount of the second-highest tote pool dividend.
4) The maximum dividend for tote win bets is $201 and the maximum dividend for tote place bets is $51.
5) If We pay an amount greater to the listed amount, we reserve the right to amend the bet to the correct listed payout. If we payout an amount greater than the listed limit and decide not to amend the payout this does not set a precedent in relation to future such payouts.
6) On any bet type in any location, we reserve the right to limit any individuals/groups so that the payout on any bet type does not exceed the largest relevant Australian tote pool size. If we payout an amount greater than the listed limit and decide not to amend the payout this does not set a precedent in relation to future such payouts.
7) In the event that topbet deems multiple clients to be working as a group, we reserve the right to apply the maximum win limits across multiple accounts collectively.
8) We reserve the right to cancel your bets if We suspect you have manipulated the tote-based dividends. If we do not cancel your bets, we reserve the right to apply a payout limit on the bet/s that does not exceed the better dividend of the remaining two Australian tote-based dividends. If this rule is waived at topbet’s discretion, it does not set a precedent to the Customer in relation to future payouts.
9) All maximum payout limits apply to you as an individual, or, where we have genuine reason to believe a group of Customers including you, have been acting in concert. Where a group have backed the same combination of sections, including where placed in a series of bets, at a range of prices, over a number of days, using different accounts in apparent collusion, we reserve the right to limit the total payment of all those bets combined to the one single maximum payout.
10) Notwithstanding any of the above maximum win limits, the total payout by topbet to any individual Customer(s) across all bets in any 24-hour period is limited to a total of $150,000.
DISPUTE RESOLUTION
1) In these Terms, a “Dispute” includes any dispute or matter between topbet and a Customer arising from the topbet Rules or relating to the products and/or services provided by topbet to Customers.
2) Where a Dispute arises, the parties will at first instance attempt to resolve the dispute without reference to external parties.
3) Where a Dispute cannot be resolved between you and us, that Dispute must be referred by you to a representative of the NSW Bookmakers’ Co-Operative and/or Racing NSW (if the dispute relates to minimum bet limits) and/or the relevant controlling body (if the nature of the Dispute is relevant to the Rules under which topbet conducts its bookmaking operations) and/or NSW Liquor and Gaming. A Dispute must be lodged by you within 14 days of the Dispute arising. The decision of the adjudicator is final and binding on you and us.
4) Calls to and from topbet will be recorded for security and compliance purposes, and your live chat history and other communication with us may be stored.
5) Where a Dispute occurs which cannot be resolved between the Customer and topbet, the Customer agrees that the recording(s) and/or any records of a Customer’s transactions via the Internet may be made available to the adjudicator of the Dispute to enable the Dispute to be determined in accordance with the topbet Rules. All records of voice recordings will be securely retained by us in accordance with our privacy obligations for regulatory purposes.
6) topbet does not warrant or imply that participation in wagers complies with the legal requirements of any state or country other than New South Wales. Customers must satisfy themselves (and assume full responsibility) for the legality of:
i) applying to topbet for an Account;
ii) remitting funds by debit card or other permitted means to an Account;
iii) placement of wagers with topbet; and
iv) receiving winnings from topbet.
LIMITATION OF LIABILITY
1) Subject to clause 4 below, you agree to fully indemnify, defend and hold topbet and its related entities harmless immediately on demand, from and against all claims, arising out of:
i) any breach of the topbet Rules by you; and
ii) any other claims arising out of your access, use or failed use of our Sites other than as expressly permitted by the topbet Rules.
2) Subject to clauses 3 and 4, our liability to you for any claim or loss incurred or suffered by you in connection with the topbet Rules or your use of our Sites is limited to the amount of the relevant bet placed by you.
3) Subject to clause 4 and unless in the event of our mistake, error, negligence, fraud or wilful misconduct, we are not liable to you for any indirect or consequential loss (even if such losses are foreseeable or if we have been notified by you of the possibility of such loss or damage occurring), including loss of profits, damage to or loss or destruction of, your device or software or any other data or information of any nature whatsoever on your device, as a result of you accessing, using, downloading or otherwise interacting with our Sites or us in any manner whatsoever.
4) If there is a statutory guarantee in relation to a product or service supplied to you by us, and our liability under that guarantee cannot be excluded but may be limited, then our liability for a breach of that guarantee is limited at our option to:
i) in the case of supply of a service, resupply of that service or paying the cost of having that service supplied again; or
ii) in the case of goods, repair or replacement of those goods, or paying the cost of having those goods supplied again.
CLOSURE OF ACCOUNTS AND INACTIVE ACCOUNTS
1) You may close your Account at any time via the ‘My Account’ section of our Sites. We will refund the balance of your Account by a method of payment determined by us. If you have any pending or unresulted bets at the time of closing your Account such bets will still stand, and if such bets subsequently win, the corresponding payout will be paid to you within a reasonable time of the outcome of the bet becoming known.
2) If you have not made a deposit or placed a bet on your Account for a period of more than 18 months, topbet may deem your account an Inactive Account. To keep an Inactive Account open you must pay a fee of $10 per month which will be deducted from your Inactive Account (unless your Account balance is $0). To avoid incurring this payment you can simply either place a bet or withdraw your funds into your bank account. If this occurs your Account will no longer be deemed an Inactive Account.
ANTI-MONEY LAUNDERING AND COUNTER-TERRORISM FINANCING (AML/CTF)
1) Australia has strict laws on money laundering and terrorism financing that may impose an obligation upon us to report you to the federal or local authorities within such jurisdictions if we know, suspect or have reason to suspect that any of your transactions, amongst other things, involve funds derived from illegal activities or are intended to conceal funds derived from illegal activities or involve the use of your Accounts to facilitate criminal activity.
2) We reserve the right to report you to the aforementioned federal or local authorities should we reasonably determine that we may be obligated by law to do so. In order to assist in the prevention of money laundering, we may suspend your Account and/or refuse to permit any substantial and/or unusual withdrawals individually and cumulatively pending receipt of reasonably requested documentation.
3) We may request documentation indicating the source of the funds you have used to deposit into your Account or the source of your wealth. Such documents will depend upon individual circumstances and may include bank statements, identification documents, share portfolios, business records. All such documentation will be treated strictly in accordance with topbet’s Privacy Policy.
INTELLECTUAL PROPERTY
1) You acknowledge and agree that all intellectual property rights in our Sites or apps, their contents (including any software), the content and data published on or in them, and all other items created by or for us remains at all times vested in us or our licensors. These intellectual property rights include, without limitation, copyright, trademarks, the underlying software, the design, graphics, layout, the look and feel and structure of our Sites, database rights, design rights, domain names and rights to goodwill and/or to sue for passing off. You are not permitted to copy or use our intellectual property, except with our prior express written consent.
2) You acknowledge and agree that our Sites and apps and the material and content contained within them, is made available for your personal non-commercial use only. Any other use of our Sites or apps and the material and content contained within them is strictly prohibited.
3) No data, file, graphics, images, documents, results or other content in our Sites or apps, including content downloaded or otherwise accessed from them, and material you may receive in connection with them, may be copied, reproduced or distributed without our prior written consent. You agree not to assist or facilitate any third party to, in any manner copy, reproduce, transmit, publish, display, distribute, commercially exploit, tamper with, modify, adapt, develop, decompile, reverse engineer or create derivative works of such material and content, or our Sites or apps or any part of them.
ASSIGNMENT
1) topbet may assign, transfer or novate any or all of its rights and obligations under the topbet Rules to any third party at any time without notice to you. You may not assign, transfer or novate any of your rights or obligations under the topbet Rules to any third party.
SIGNIFICANT EVENTS
1) To the extent there is any inconsistency between these General Terms and Conditions and the rules applying to a specific event or race, the following general terms will prevail.
2) If an event(s) occurs beyond the reasonable control of topbet such as an epidemic, pandemic, flood, fire, earthquake, element of nature or act of God, act of war, terrorism, riot, rebellion, strike, blockade, labour disruption or other cause, that materially impacts any sporting, racing or other event (or a series of events or races in a season) which is the subject of a contingency or outcome of a market offered by topbet, topbet may (acting in good faith) exercise its discretion to void, cancel, restrict or otherwise alter or adjust the payout (in whole or in part) of the affected wager(s) placed on the relevant market (including, without limitation, retrospectively take any of the actions contemplated above once a bet has been struck and before or after it has resulted). For the avoidance of doubt, an “impact” on any sporting, racing or other event includes, without limitation:
i) any reduction in the number of games, matches or race meetings in a season;
ii) any material change in the length of a game or match or when the matches are played or races are run;
iii) a material change to the format or rules of the relevant event(s), series, competition or race(s) as determined by the relevant sports or racing body; or
iv) a change in the location of any match, game, race or event.
3) Where a sporting or racing body announces or declares a material change to the structure of a competition, event or race (including, but not limited to, the number of players in a match, matches or races in season or the time, location or date of the event(s) or race(s)), and topbet considers (acting reasonably) that such change will have a material impact on a market or bet type taken on, or involving, that competition, event(s) or race(s), all bets on the affected market(s) may be voided by topbet at its discretion (acting reasonably and as soon as reasonably practicable following a relevant announcement). All affected bets (including legs of multi bets) which rely on a number or series of matches or games occurring within a season which are cancelled, will be recalculated accordingly.
BONUS BETS & PROMOTIONAL OFFERS
1) Bonus bets may be awarded to selected Customers pursuant to various promotions offered by topbet or as otherwise directed, at topbet’s sole discretion.
2) Unless stated otherwise in a specific offer, bonus bets will expire 7 days after issue date.
3) For winning bonus bets, winnings will be paid excluding the initial bonus bet stake. This means that if a bonus bet to the value of $100 is placed on a selection paying $2.50, the net winnings paid will be $150, (i.e. $250 less the $100 bonus bet).
4) Unless otherwise specified, bonus bets may be used as a single bet on fixed odds Australian racing markets or as part of a multi bet on any sport or Australian racing market available at the time of bet placement, excluding any other markets outlined in the specific promotion terms and conditions. Only one bonus bet (from any promotion) can be used per event or match. Events and matches available for the use of a bonus bet is at the sole discretion of topbet and can be changed at any time.
5) Unless otherwise approved in advance by topbet, the maximum bonus bet wager on any one event is $1000.
6) Unless otherwise specified in the terms and conditions for a promotion, any qualifying deposit made to obtain a bonus bet must be turned over at least once at odds of at least $1.50 before you can make a withdrawal from your Account. There are no turnover requirements on bonus bet winnings.
7) topbet reserves the right, in its absolute discretion, to refuse to allow a Customer to participate in promotional offers. topbet will endeavour to provide written notification to any such Customer whom topbet determines will not be eligible to participate in promotional offers.
8) Customers considered to be abusing bonus bets or promotional offers by any means (or who breach the topbet Rules) may have their eligibility for bonus bets and promotional offers, and any winnings from such bonus bets and promotional offers cancelled or revoked.
9) The maximum winnings payable on any bonus bet is $5,000.
10) Any promotion offered by topbet that may result in the awarding of bonus bets can only be entered once per Customer / person, residence / IP address / computer / smartphone / tablet. topbet may determine, in its sole discretion acting reasonably, whether it believes different entries or accounts are associated with the same person.
11) topbet reserves the right to cancel, change or suspend any promotion or bonus bet at any time without notification.
12) topbet promotions which offer the possibility of bonus bets may include specific terms and conditions related to when bonus bets can be used, i.e. restricted to use on specific events, or with a specific expiry date and Customers should read the restrictions, if any, disclosed in any additional terms and conditions. Bonus bets cannot be used to earn additional bonus bets.
BOOST
1) The standard rules contained in topbet’s Betting Rules, including deductions, also apply to Boost bets.
2) topbet may in its absolute discretion, offer the Boost feature to selected Customers for selected products, markets, pricing or bet types. topbet reserves the right to change, suspend or remove the availability of the Boost feature at any time.
3) The Boost feature is not available on bets where a bonus bet has been used.
4) The maximum winnings using boosted odds will be limited to $5,000.
5) The number of boosts which may be made available to you in a particular day will be at topbet's absolute discretion. All Boost bets made available to you will expire each day at midnight (Sydney time). No boosts will roll-over to the following day.
6) The price available to you when you apply your boost will be at topbet's absolute discretion.
7) Your boost will be considered to have been used and will not be available for any other bets that day if:
i) your boost bet (or any part of your boosted bet) is declined for any reason;
ii) an alternative stake and price are offered on your boosted bet and you do not accept that offer;
iii) your boosted bet is voided or your bet selection is scratched; or
iv) you have a screen time out while your boost bet is being processed and before your boosted bet is accepted.
8) Boost is intended for recreational punters. Professional gamblers and Customers deemed by topbet to be abusing the spirit of boosts will not be eligible for the enhancement. topbet reserves the right to make boosts unavailable to Customers considered to be abusing boost or other promotions.
BET RETURN
1) topbet may in its absolute discretion, offer the Bet Return feature to selected Customers for selected products, markets, pricing or bet types. topbet reserves the right to change, suspend or remove the availability of the Bet Return feature at any time.
2) The Racing Bet Return feature requires a minimum of six runners.
3) The SGM Bet Return feature requires a minimum of four legs. The SGM Bet Return feature requires minimum odds of $2.
4) Applies to the first fixed odds win cash bet on Racing. Applies to the first eligible cash bet on SGM.
5) Bet Return feature is not available on bets where a Bonus Bet or Boost has been used.
6) Single bets only.
PROTEST PAYOUT
1) In the event where a result is amended after a Stewards’ enquiry, topbet will pay out on both the interim winner and the winner as declared by official dividends on all win and win proportions of each way bets. Available on Australian thoroughbred races only.
2) For the topbet protest payout, in the event of a runner being relegated on protest (not disqualified) topbet will pay out on the original past the post result and the final official result on all (fixed and tote) win and win portion of each way bets.
3) Protest payouts are available for single bets only. Multi bets are not eligible for protest payouts.
4) Protest payouts apply win only and the win portion of each way bets.
5) Protest payouts apply to bets placed on the final field market. Futures bets are not eligible for Protest Payouts.
6) Protest payouts are not available for quinella, exacta, trifecta, first four, early quaddie or quaddie bet types.
7) For the protest payout, the Win dividends will be calculated using the final declared dividend displayed on each TABs website or the fixed price as confirmed by the Customer in their bet slip.
8) Protest payouts only apply for official protests and not disqualifications (including weighing in incorrectly).
9) Protest payouts only apply to races where the horse that is first past the post is relegated. There will not be a protest payout payment where a horse finishes in 2nd or 3rd and falls out of a placing as a result of the protest.
10) The maximum payout for a protest payout is $1,000 per Customer per race.
11) Bonus bets and other promotional offers are ineligible for the protest payout.
12) Customers are not eligible to be paid out on two runners in the same race.
13) The payout value will equal the full return the Customer would have received had the horse been declared the official winner, subject to our Betting rules and maximum payout limits.
